Tlic Chief Justice to-day dismissed the appeal of the Fresh' Food and ice Company against its conviction Tor having sold milk adulterated with water. Sir Uobcrt Stout said the statute threw the responsibility for tho sale of food on the vendor; therefore a defence based upon the absence of mons rea, was not open to defendant company unless it proved affirmatively that it had taken all reasonable steps so that the sale would not constitute an offence, or had obtained from the person from whom it bought tho milk a written warranty as to the article to l>o sold.
