The application for the dischargefrom the w.rit of attachment against Thomas Kennedy Macdonald, in the case of Rose and others v. Macdonald, was heard to-day 'before -'ir Bobert Stout and Mr Justice Olunpm«in.
Macdonald, in an aflidavit. said that .before the proceedings became public, he had offered plaintiffs £2000 cash and l tlio ba.lanoe in instalments extending over three years. Since the publicity given had politically ruined bis business, and lie was muible now to raise that -•'; n. He also .still believed there was a sum of £2000 owing to him for commission in the estate.
In view of the affidavits of •'ie plaintiff's doctors tlio Pencil cons: 1ered that Macdbiuild'x life wouM be imperilled by a period of detent'; 01.1, and consequent mental distress, and they granted the application for discharge. Mncdonald was ordcfcl to pay the costs of the present vit.
