%d to empower the Superintendent to erect a Toll Gate. liSjl'-Ci'XftS it is necessary to provide means tor keeping in repair the main roads through the Province. it fymfan factefc by the Superintendent of the Province of Hawke’s Bay, with the advice and consent of the Provincial Council thereof as follows :
I. The Superintendent, with the advice of the Executive Council, is hereby authorised to erect a Toll Bar and other works necessary thereto at a convenient place between the Southern Boundary of the Town of Napier and Tareba’s Bridge, and from time to time to appoint and remove keepers for the same and issue regulations for their guidance and shall fix by proclamation in the Government Gazette the day on and after which Tolls shall be.levied at such Toil-bar, and shall fix the rate of Tolls to be levied at such Toll-bar. H. No Toll shall be demanded or taken for any horse or carriage belonging to or under hire to the Government of the Province, and em ployed at the same time of passing through the gate on Provincial Government service; or in respect of any horse, beast, carriage, or other vehicle conveying the Post Office mails, or horses of any of her Majesty’s officers and soldiers on duty, and officers not on duty, being in proper staff, regimental, or military uniform, or any carriage or horses belonging to her Majesty or employed in her service.
HI. The Collector shall put up and continue at the Toll-gate a table to be printed or painted in distinct black colors and figures with a white ground, of all Tolls there .payable, and shall renew such table whenever any letters or figures thereof shall be defaced.
IV, The Collector shall give satisfactory security for duly accounting for and paying over the money received by him,... : V. The Superintendent may at any time lease the Tolls by public auction, or tender for any period'not exceeding one year at, one time, subject to such conditious and regulations as he may think fit: Provided they are not repugnant to the provisions of this Act..' .
VI. If any Collector shall not place such board as aforesaid and keep the same there during the time he shall be Collector, or ; shall demand a greater or less Toll from any person than he shall be authorised to do by virtue of this’ Act, hr. shall refuse; to permit or shall iu any, wise hinder any person from reading the inscription on the Toll-board, or shall refuse to tell bis name to any person who ’shall demand the same, or. shall give a false name, or on the legal-ToU being paid detain or wilfully obstruct or hinder any pas-
senger from' passing through the Toll gate,"or make,use of any scurrilous language’ to any passenger or other person there—in every such case the Toll Collector shall forfeit for every such offence, any sum not exceeding Ten Pounds.
■ VII. If any person shall do any act whatever in order or with intent to evade the payment of all or any of the Tolls by this Act imposed, and whereby the same .shall be evaded, —every such person shall for every such offence forfeit and pay any sum i?ot exceeding Five Pounds, in addition to the Toll evaded, to be recovered in a summary way,as,hereinafter provided for. VIH. All penalties imposed by this Act shall be recovered by sum aiary proceedings before Justices of the Peace.
IX. For the purposes of this Act wherever the word Superintendent shall be used, the same shall be held to mean the Superintendent acting by and with the advice of the Executive Council.
X. The short title of this Act shall be “ The Toll Gate Act, 1867.”
