Friday, May 5. The case of Sir David Munro v. Collins and Luckie, of the Colonist newspaper, was heard to-day. Pitt applied on.behalf of Monro for the rule to be made absolute, Fell opposed for the Colonist, and raised preliminary objections as to insufficient proof of publication. Fell cited numerous cases, and the Judge rnled on the case of Regina v. Baldwin, that the rule must be discharged. Co«ts were not allowed, as the point on which the case was dismissed was a technical one. The libel arose from the assertion that Munro, in 1862, put back the clock of the House of Representatives to carry a party measure, Fox and Luckie filed affidavits in reply, which contradicted the affidavit of Sir D. Monro, but they were not read in Court.
