SUPREME COURT of NEW ZEALAND.

Wednesday, 13th February. Buchanan, Appellant ; Green, Respondent. The question of costs which stood over from Monday was again argued by the counsel herein ; but His Honor said that Mr Wilson had failed to show cause why he should step out of the ordinarycourse, viz., that the successful party should have his costs; although in the case before him he would have been glad to have made no order as to costs, as the fault was not that of the respondent, but the Justices. Ordered that respondent pay all costs. Mr Wilson ashed His Honor that the order might stand over until he could appeal to the Court of Appeal on error. His Honor intimated that he could not sec how any error would lie. Application refused.
