William Wilcox, being sworn, said, —I am chief officer of the barque Lorenzo Sabine, now lying in Nelson harbor. Prisoner shipped as cook and steward on board that vessel. I received information yesterday that the prisoner had been using abusive language to one of the female passengers on board. This was between 2 and 3 o’clock. I heard some one crying, and went aft, when I heard the prisoner using abusive language to a female passenger. 1 called on the second mate to witness it. Prisoner also about to strike the woman. The second mate and I went and ordered prisoner to 'go on, deck, He refused, and said he would punch my head, and he struck me in the face. I knocked prisoner down outside the cabin door, and he then got up and went to his pantry. I beard knives rattle, and prisoner came out immediately with a carving knife in his hand. He went in a direction from the pantry towards the main hatch. I stood near the main hatch; the second mate was nearer the cabin. As prisoner went from the panty to the hatch, he said he would cut my liver out. The second mate ran up to disarm him. Directlyjthey met, prisoner raised his right arm, and struck a blow upwards and forwards with the knife. I did pot then know he had caused’a* wound. Prisoner was then secured and disarmed. I assisted in doing that. The second mate about three minutes afterwards; said he was wounded. I sent him immediately to the hospital. I saw that his bowels were protruding from the wound. The knife the prisoner held is the I dare say it was from threejto four minutes from the time I struck prisoner until he came out with the knife.
