contracted to be done byjhiru, and which ’ defendant had refused to pay. A Jury was summoned in the case, but the parties signed an order of reference, the plaintiff appointing William Miller as his arbitrator, and defendant Robert Holt ; award to be given over before the 20th June next, costs to be at the discretion of the arbitrators.
