AN ACT to appoint Commissioners to adjust certain claims and matters of account depending between the Provinces of Wellington and Hawke's Bag. "W" HE REAS certain claims have been made on behalf of the Province oi Wellington against the Province of Hawke’s Bay in respect of cor t niii loans raised by the said Province of Wellington and certain other matters of acccount are pending between the said Provinces: And Whereas it is expedient to appoint Commissioners to confer with Commissioners appointed by an Act of the Provincial Council of Wellington and adjust the said Claims and matters of account. Be it therefore Enacted, by the Superintendent of the said Province of Hawke’s Bay, by and with the advice and consent of the Provincial Council thereof, as follows : 1. That Esquires be appointed Commissioners for the purpose of investigating and adjusting the said Claims with Commissioners appointed as aforesaid on behalf of the Province of Wellington, and also of settling all matters of account between the said Provinces of Hawke’s Bay and Wellington. 2. The said Commissioners shall have power to adjust and finally settle the claims and matters of account before mentioned, and any agreement of settlement of the said claims and matters of account made by them for that purpose shall be binding and conclusive. 8. Provided that in the event of the Commissioners of the Provinces of Wellington and Hawke’s Bay respectively, not arriving at a conclusion and agreeing thereon before the next meeting of the General Assembly, that it shall be left to His Excellency the Governor to appoint a Commission to hear and decide the question. 4. In case either of the Commissioners so appointed shall die, resign, or become incapable of acting therein, before such adjustment shall be completed, the Superintendent may appoint another person to be Commissioner in his stead, and such newlyappointed Commissioner shall have the same authority and power as the Commissioner in whose place he was appointed. 5. Provided always that in the case of either the aforesaid now members of this Provincial Council, or any other member of the Provincial Council, who shall at any time be appointed a Commissioner under this Act, his seat in the Provincial Council shall not become vacant notwithstanding anything to the contrary contained in the Act of the Provincial Council of Wellington, Session 1, No. 26, intituled “An Act to make void the Election of certain members of the Provincial Council.”

AJs ACT to constitute a Marine Board for the Port of Napier, to he called “ The Napier Marine Board." ~W~IIE HE AS it is expedient that a Marine Board should he constituted for the Port of Napier, pursuant to an Act of the General Assembly of New Zealand, intituled “ The Marine Board, 1862.” Be it therefore Enacted by the Superintendent of Hawke’s Bay, with the advice and consent of the Provincial Council thereof, as follows; 1. Eor the purposes of this Act, there shall be a Marine Board for the Port of Napier, and said Board shall be called “ The N apier M arine Board. ’ 5 2. Such Board shall consist of three Wardens. 3. The said Board shall possess and exercise the several powers and authorities and perform the several functions and duties conferred by and contained and set forth in the Act before mentioned, namely: “The Marine Board Act, 1862,” and thereby expressed to be conferred upon Marine Boards. 1. The Wardens shall be appointed and removable by the Superintendent of the said Province, and all Appointments and Vacancies shall be made and tiled in the manner required by the Act lastly mentioned. 3. It shall be lawful for the Superintendent of the said Province to define the limits of jurisdiction of the said Board by a Proclamation under his hand to be published in the Government Gazette of the Province.
