RESIDENT MAGISTRATE’S COURT
Lechner v. Nias. The plaiatiff in this case sued defendant, who is captain of the brigantine Dart, for his commission upon the outward and inward cargo, amounting to £l9 Is. 6d. Plaintiff stated that he was agent for the Dart ; that tlie amount of freight of her inward cargo to C 5 O Napier was £272 3s. 2d y and the amount of freight of her outward cargo to Sydney was <£lo9 11s. Bd., and that 5 per cent, on those sums made up his claim, and that he charging what was usual. Mr. Begg and Mr. Kinross corroborated the plaintiff’s statement as to the amount of freight, and the custom as pursued by agents of vessels. Defendant denied that be bad employed plaintiff in any other capacity thau custom
house agent, but Mr. Begg proved that the plaintiff had got his portion of the freight for the vessel, and thathe captain was with him when he did so. Judgment for plaintiff for whole amount ■end costs, 15s.
