WELLINGTON.
The Matu, tjorougii Case. —His Honor the Judge pave his dcccsion on this case last Saturday. Wc hope to publish it in full, from which ’t mil be seen that Mr. Eyes’s claim to the Superintendcncy is decided against. We gather that
His Honor will recommend the General Govern' inent to dissolve the Council, and so refer the fu' tore Superintendent to the decision of the elec' tors, who will doubtless make the question of support to Mr. Eyes or Captain Baillie a cardinal point in the election of Council members.—lndependent, January 6. .Assault Cases. —At the Resident Magistrate’s Court, on the 29th ult., George Bolton, of Wellington, shingler, was fined 40s. and costs, forhaving assaulted the Hon. Algernon Gray Tollemache, on board the steamer “ Storm Bird,” on her passage from Nelson to Wellington on or about the 10th December, last. From the evidence, which is very lengthy, it appears that the defendant had fixed a rope, having a slip noose, round the right leg of the plantin' whilst lying in his berth, and that some one on deck pulled at the rope. A second case, arising out of the above was brought by Mr. William Bromley against theplaintilf in the above case, for having, whilst endeavouring to settle the above assault at the house ot Air. Tollemache, been taken by the collar, thrown down and dragged towards defendant’s garden gate. The Court thought that the defendant had used more than necessary force to remove the complainant, notwithstanding his misconduct, and fined him Is. and costs.
