DISTRICT COURT.
Wednesday, September 17. Buchanan v, Fitzgerald. This was an action to recover <£loo, the value, less certain sums credited in the bill of particulars, and .£l2 16s. Bd., of certain goods, the property of the plaintiff, and wrongfully withheld by the defendant. The plaintiff made some alteration in the plaint, reducing the amount claimed to £92 16s. Bd. Defendant did not appear, and judgment was given for the amount claimed and costs. Malibij and another v. Luff. An action for damages for breach of contract for the purchase of certain sections of haul ut Havelock, sold by auction, which defendant did not complete pursuant to conditions of sale ; the laud having been resold, at defendant’s risk. The action was therefore brought to recover the loss sustained by the sections not realizing the price at which they were sold to defendant, and the expenses incurred. Mr. Wilson appeared for the plaintiffs. Judgment deferred till to-day (Thursday). Stuart and another v. Topping and another. An action to recover £B4 2s. 2d. for goods sold and delivered, and interest. Mr. Wilson appealed for plaintiffs. Mr. Topping did not appear, but the other defendant, Mr. Turner, denied his liability in the transaction. Judgment deferred till to-day. Stuart and another v. Thompson. An action for £37 3s. 4d. for goods sold and delivered. Mr. Wilson appeared for plaintiffs. Defendant filed an admission of the claim. Judgment for ]ffaintiffs for £4l 7s. 4d., including costs. Stcivart and another v. Allan. Mr. Wilson, who appeared for the plaintiffs, applied for an adjournment in this case, as defendant had been accidentally drowned since the service of the summons. Adjourned.
