August 15th. Thomas Masterton was fined 10s, for drunkness. Doitsh Sj* Henry v. Lanyford. A Claim of dill 2s. 6gd. Judgment by default for whole amount and costs. August 16th. John Harvey, was fined ss. for drunkenness. Robert Howlet, was fined Bs. for drunkenness. Commited in default for 48 hours. Thomas Masterton, was convicted in a penalty of AI, and sentenced to 14 days imprisonment. August 18th. Stuart, Kinross, <§• Co. v. Miles. A claim for the refund of A 5, exacted from the Plaintiff (as demurrage of the Gil BlasJ under a threat of stopping the discharge of the cargo. The Plaintiffs produced the charter party in which it was stipulated that the vessel was to convey 200 tons of coal, more or less, from Newcastle to Napier for Messrs. Stuart, Kinross, & Co.—that she was not to draw more than 11 feet, and that <£s demurrage per day was to be paid by the charterers for all delay in discharging cargo beyond 6 days. Notice was given on Wednesday, Gth, that the vessel was ready for discharging, and the cargo was out on Saturday, 16th. The Plaintiff said the weather would not allow of men working, and that the vessel drew than 11 ft. Thomas Murray, Pilot and Harbor Master, stated that to the best of his belief the vessel drew lift 2in. but that made not tha slightest diffei’ence as to the mooring of her. Judgment for defendant, and costs 16s. August 19th. Carswell v. Gason. A Claim of-£7 9s. 9d. Judgment by default for whole amount, and costs. Reynolds v. Cash. A Claim of £4 9s. Settled out of Court. Same v. Barriyan. A Claim of £1 19s. 3d. Settled out of Court. Same v. Davis.
A Claim of £2 11s. Settled out of Court. Same v. McNah. A Claim of £S Os. 6d. Judgment ex parte for the amount claimed and costs £2 18s. Powles 8f Maney v. Wilson. A Claim of £3 16s. Cd. Settled out of Court.
