Jury Fails To Agree ' FIRST TIME IN VICTORIA (Received 30. 9.30 a.m.) MELBOURNE, July 29. The ;jury disagreed at the fourth. trial of the charge against Ropert Davies and William John Cody of having murdercd James Edward Scriven, a Titlel Office messenger, on January 31. The , prisoners were remanded for a further trial. This is the first occasion on which a person in Yictoria has been tried four tiuies for a capital offence. If the new trial proceeds it will be the first time in Australia a person has stood a flfth trial. The recent praetice has been to atandon the prosecution after three abortive trials. At the first trial the jury disagreed, the eecond jury found accused guilty and they were sentenced to death. The appeais to the Oourt of Criminal Appcals were dismissed, but the appeals to the High Court were upheld and a I'ow trial ordered, which resulted in a disagreement.
