Mr. J. Cassidy, who was appearing for Russell, claimed that Makt injured a fetlock and legs as the result of which his chances of winning the A.J.C. Derby and subsequent Sydney and Melbourne cJassic events, also the Great Northern Derby in New Zealand, were seriously prejudiced. The mishap, Mr. Cassidy contended, was primarily due to the escessive speed of the tram.
