CLAIM FOR £50,000
Sequel to Steamer Collision (Eeceived 22, 8.45 a.m.) MELBOUEN), June 21. The hearing of the Union Steam Ship Company 's elaim for £50,000 in connection with the collision between the Kakariki and the Oaradale in Port Phillip on January 29, began in the High Court to-day. The defendants are "the ship Caradale and her freight cargo." The defendants connterclaimed for £25,000. The collision resulted in the sinking of the Kakariki with a loss of five lives. The plaintiff company claims that the Kakariki was navigated properly with regard to safety and that the Caradale neglected to keep a proper look-out, failed to warn her change of course, and failed to stop or reverse when the collision must have been apparent. The defendants deny that the collision was caused or contributed to by negligence or improper navigation. ( The owners of the Caradale say the collision was caused solely by the negligent navigation of the Kakariki, which, having become a crossing ves_ sel, failed to keep out of the way of the Caradale.
