Special Sitting Without Judge UNUSUAL POSITION

WELLINGTON, Last Night. With a view to expediting the business Of the Court of Arbitration, it has . been decided to hold a special sitting in Wellington on April 28. The Court will consist only of the two lay members, Messrs Prime and Monteith. The president of the Court, Mr Justice Page, is unwell, and Mr Justice NorthcTOft, Who was recently appointed an actingjudge of . the Court of Arbitration, will not be available for this special sitting, as he will be engaged in Supreme Court business at Christchurch at that time. The lay members will deal with in- , ■dustrial disputes in which complete jagreement has been reachcd in the ICoUciliation Councils. These agreeiments will be made ifito awards when the consent of the acting-judge is lobtaine'd at a properly constituted sitjtittg of the Court. The presence of the IjUdge and oue other member of the lCourt is required to constitute a- sitting, Tt will, aecordingly, be necessary to conjstitute a sitting and a special sitting will be adjourned in conformiiy with jSection 78 (d) of the Industrial Coniciliation and Arbitration Act, to a date j jduring the Christchurch sitting. This section provides that the Cottrt |may be adjourned from place to place land time to time by the Court or the j judge, or if the judge is absent, then Iby any other member present. Recomimendatiofis received from the ConciliaJtion Co'uncils will be passed on by the jlay members from the special Wellington sitting to the judge when the Court |resumes at Christchurch. It will not, of coprse, be necessary for /the advocates concerned in the Wellington sitting to appear again at Christchurch. With regard to parties seeking lexemption to awards, lay members of' the Court and piepared to hear statements and arguments in support. If it appears to them a prima faeie case has been made out iri respect to any such party, then snch party will be struck out when the award is nrnde. Thia will be without prejudice, however, and the making of a fresh application to adcl parties so struck out can be heard when the Court returna to. the district affecfr' ed. ✓ ' * 4
