Inquiry To Be Made for Next-of-Kin

AUCKLAND, Last Night. Tbe Supreme Court was asked to taki steps to ascertain relatives who are em titled to shara in the residue of tho estate of the late Mrs. Catherine Smith, widow pf Captain James Smith, of Auckland. When Mrs. Smith died on August 12, 1933, ber estate was valued at over £126,000, and the estimated value of the residue now to be disposed pf is about £80,000. - When the case was before Mr. Justice Cailan, oue eoupsel stated there would be 45 relatives elaimiug tp share in this residue. Mrs. Smith 'g will lef't the residue of the estate to charities in or about Auckland, but the Court of Appeal and afterwards th^ Privy Council, held that this clause was invalid tbrough s defecj in the wording and the residue, therefore, goes to kinsfolk. His Honour made an order for the yegistrar to inquire who are the nestOf kin.
