Ruling by Magistrate

CHRISTCHURCH, Feb. 12. . •■ The provisions of the Shops and Offices Aet in regard to hours of work apply to milk vendors, according to re> served judgment delivered by Mr Reid, S.M., in the Magistrate 's Court to-day.. The Magistrate said he must look at the general purport of the Statute as a whole. It was a remedial Act, and its . object was to regulate and ameliorsfte the working conditions of employees in shops and offices, and analagous businesses. It was clear that, generally speaking, the Act was intended to apply to milkmen, and it would be unreasonable to hold that defendant could escape the Statute. If he could do so he could compete on unequal terms with other milk vendors who conducted their businesses in such a manner as to bring them, in any case, within the scope of the Act, The Magistrate contended that a broad construction tfhould be placed on Section 36, and therefore he held that defendant must be convicted. A fine of £2 was imposed.
