Wairoa Council Sues A /Ratepayer UNUSUAL CASE

WAIROA, Jan. 23. An unusual case was heard in the Magistrate's Court yesterday when the Wairoa Borough Council claimed from Jane Williamson, married woman, owner of the New Wairoa Hotel, the sum of £5, being a subsidy promised to the council for bitumenising a drive on the river bank opposite the hotel, for the benefifc of the Royal party during the visit of the Duke of Gloucester. Judgment was given for the council. Mr Chamberlain appeared for the council and Mr O 'Malley for def endaut. The deputy-Mayor, Cr. M. J. Gem-. mell, and the town clerk gave evidence of a verbal agreement. Defendant did not deny that thiis was made, but alleged that the construction work was faulty. Mr O 'Malley contended the council had no power to make such a contract with a ratepayer of an expenditure of over £20. Mr Chamberlain said that if this contention were upheld there could be no improvement made to half the backblocks road.
