CLAIMS FOR PENALTIES
Inspector Proceeds Against Hotel Proprietor ALLEGED UNDER-PAYMENT Claims for penalties under the Finance Act for alleged under-payment of employees were made by tbe Inspector of Awards, Mr. A. E. Wood, in tbe Napier Magistrate's Couxt yesterday, before Mr J%Miller, S.M., against Henry Eodley, proprietor of tbe Club Private Hotel on tbe Marine Parade, Napier. Tbe defendant, wbo was represented by Mr Jobn Mason, admitted tbe faets but entered a legal defence. Decision was reserved. Tbe statement of claim set out tliat fcbe plaintiff claimed to recover from tbe defendant the sum of £5 as a penalty for breacb of 'tbe Finance Act, 1936. The following ivere the particulars of tbe allege1 breacb : — That defendant, during tbe period between July 1, 1936, and October 9, 1936, employed Miss B. Hewett, cook, and Mrs. E. Pascoe, bousemaid-waitress, and ' paid • tbem, wben employed by him for the stated period, less tban the rate "of remuneration to wbicb tbe workers were entitled according to the provisions of section 16 (1 and 2) under tbe Finance Act. L936. . ' ' The plaintiff also claimed a penalty for anotlier alleged breacb "of the same Act. The following are tbe particulars : Tbat defendant, during tbe period between October 9,' 1936, and . October 15, L936, employed Mrs Matber, houscinaidwaitress, and paid her less tban the rate of the remuneration to which slie was entitled according to tbe provision of section ' (1 and 2) of tbe Finance Act', 1936. Tbe facts regarding the employment of the tbree workers were admitted by the defence, and throughout tbe greater part of the bearing legal argument proceeded regarding tbe inspector's mterpretation of the Act.
