WILLIE TONG OR TAI SING
CHINESE GAOLED FOR DEBT
JUDGE CALLED ON TO DECIDE.
(By Telegraph—Press Association.)
AUCKLAND, June 15.
Mr. Justice Reed on Friday in the Supreme Court will be called on to decide whether a Chinese now in Mt Ecb;n gaol is Willie Tong or Tai Sing. To-day the judge heard an application for a writ of Habeas Corpus and granted a rule nisi calling on the gaoler to produce the body of Willie Tong at the court on Friday and to show cause why he should be detained. Last year a judgment was obtained against Tai Sing for debt and in February a magistrate fixed the penalty in default of payment at ten days’ imprisonment. It is now alleged that the papers were served on Tong, who took no notice of them until last month when he realised the seriousness of the position. Ho applied for a rehearing and this was refused by th-sj magistrate on the ground that judgment had been obtained against Tai Sing. On Monday the Chinese,, who claimed to be Tong, was imprisoned.
