COUNCILLOR LOSES SEAT
RESULT OF COURT CONVICTION
WAITAR-A BOROUGI-I COUNCIL.
Owing to his conviction for an ■offence punishable by imprisonment, and not yet having suffered the penalty imposed on him, Mr T. B. Ewens has vacated. , his seat on the Waitara Borough Council and an election will he held to fill the vacancy. The vacancy is deemed .to have occurred last- Friday, the -date of the conviction, and according to law nominations of candidates for the seat must be called not sooner than 25 days or later than 2S days from .that date. The section of the Municipal Corporations Act dealing with the matter contains the following parts relative to the case: “The following persons shall be incapable of being elected to be or of being councillors or Mayors: (f) A person convicted of any offence punishable by imprisonment unless he has received a free pardon or has served his sentence or otherwise suffered the penalty imposed on him.” The Act also disqualifies Mr Ewens from contending the vacant seat until the six months, within which he might be called up for sentence, has expired.
