PREMIUM. BY ASSISTANT. AN ILLEGAL FEE. (by TELEGRAPH PRESS ASSOCIATION.' I PALMERSTON N., July 15. Reserved judgment was delivered by Mr. Stout, S.M., in the case wherein the. inspector of factories, on behalf of Margaret Flossie Martin, of Wanganui, proceeded against Jane Barnett Currie, hair specialist of Palmerston North, claiming a refund of £25,, part of the premium paid to defendant as occupier of a, factory by Miss Martin in respect to her employment. The inspector also proceeded against defendant for a breach of the Shops and Offices Act, in that being the occupier of a shop within the meaning of the Act she did receive a premium in respect to the employment of Miss Martin while employed as assistant. His Worship said it was admitted that the defendant's premises were a. shop within the meaning of the Act, and therefore Miss Martin was an apprentice and assistant. Defendant, by accepting a premium to teach her, committed a breach of the Act, and he ruled that the £25 paid be recovered. He fined defendant £2 for a breach of the Act. stating that as she may have acted in a bona, fide manner a heavy penalty was not calied for.
