APPEAL COURT.
. CASE AGAINST ATTORNEYGENERAL. (BY TELEGRAPH —PRESS ASSOCIATION.) WELLINGTON, July 14. The Court of Appeal is to-day engaged in considering the case (removed into the Court of Appeal) of McDouga.il v. Attorney-General and the permanenthead of the Railway Department. The question for the court is the interpretation of sections 12 and 14 of the Public Service Expenditure Adjustment Act, 1921, and of the regulations under section 14. McDougall is- a leading litter in the railway service, and contends he has not been paid the scale increase of salary to which he is entitled. A preliminary point was taken bv the Attorney-General that the Declaratory Judgments Act, 1908, under which the proceedings were issued, could not be involved in any matter in New Zealand in which the Crown is to be bound
Mr. Slcerrett, K.C’., with him Mr. O’Leary, appealed for the plaintiff, Sir Francis Bell, K.C'., for the Attor-ney-General and Mr. Myers, K.C..'for the Railway,Department DIVORCE EXPENSES. The Court dismissed the appeal in the Toogood v. Nash case (July 1), holding that the husband was not liable lor costs incurred by liis wife in unsuccessfully bringing or defending divorce proceedings against the bus” hand. An application for leave to appeal to the Privy Council was reserved for consideration.
