MAGISTRATE’S COURT.

Civil Business. Mr W. Meld rum. S.Maeauresidod at a civil sitting of the NiißHfeate’s Court yesterday morning. UNDEFENDED CASES. Judgment was given for plaintiff in the following undefended cases:— J. Mandi and Co. (Air Hannan) v. Colin Campbell, £2B/0/9, costs £4/3/6. Clive L. Kettle (Air Hannan) v. Colin Campbell, £26/15/-, costs £4/1/6. Henry Breitstadt (Air Joyce) v. Seddon Chamberlain, £ll/14/-, costs £3 17/-. B. C. Wacher (Air Kitchingham) v. Colin Campbell, £22/2/-, costs £4/1/6. C. Smith Ltd., v. A. Al. Dense, £l6 3/1; costs £l/14/-. B. L. Hart and Co. (Air Revell) secured a judgment summons order against B. Peters for £6 and costs 15/6, in default 14 days in gaol. A STOREKEEPER’S ACCOUNT. Thomas Sweetman, of Roa, storekeeper, (Air Doogan), sued Al. O’Brien, of, Rapahoe, miner (Air W. P. McCarthy) | for £6/4/6, the value of cash lent (£5), and goods supplied. Plaintiff, in his evidence, produced his books showing entries for the goods in question, and showing also payment of the £5 to defendant, from whom, he said, he did not get a receipt. Defendant had left some tools with plaintiff and told him to do what he wished with them. He kept them for two and a half years, and then sold them. Defendant had perviously borrowed small sums from plaintiff, but had always repaid them.

Defendant said he did not remember having borrowed £5. The only time he had borrowed from plaintiff he had given him an order on his wages. He denied getting the goods.

After cross-examination at consider able length, His Worship gave judgment for plaintiff for the amount claimed, with costs totalling £2/18/6.
