The parties happened to meet at M'Kenzie's AH Nations Hotel - t \ on the Brunner Parade, at No, Town,, on the eve of Christmas Day, and there appeared to be a : kind of free fight going on, xin which the complainant got maltreated by somebody. The assault was : proved^by the complainant and a witness named Livingstone. The defence was .a total denial of the assault ; and tiie defendant asserted ' that 'inst!ead ; 'of ■ assaulting the plaintiff, he actually .prevented another man from seriously injuring him! -A witness was called for the defence to prove this. This witness gaveT his evidence in a most disrespectful and. supercilious manner. On being asked what he was doing at the house? he insolently remarked that " he was boozing up, like the rest of the crowd." He denied ;that the defendant struck the plaintiff." The defendant was fined L 3, with costs, or -one week's imprisonment. ■' i John Quinlivan v. Miunie Brown and Elizabeth Anderson.— A charge of using abusing language at No Town towards the complainant. One of the defendants was further charged with assaulting the complainant. G.HesTop.-^The defendant was summoned for Usiug abusive and insulting language towards the complainant at the Twelve-Mile Landing, ou 31st December. The defendant is a farmer, near the Arnold River, and the complainant has a number of cattle grazing in the vicinity. These cattle broke through the defendant's fence, .and did some damage, to his.crops.' On defendant's remonstrating with the complainant, on the disorderly 'conduct'of his cattle, high words ensued, and the language now complained of was alleged to nave been used. Several witnesses were called on either side, and the defendant was eventually fined 20s with costs. The defendant intimated that' an action for trespass was pending between' the present complainant and himself., .'." . , Ellen Page was called on a charge of 'ising abusive language at No Town. The defendant did not appear, and her, bail money (L 5) was forfeited. Sarah Ann Winters and Maggie Scanlon were similarly charged, but neither of fthe defendants appeared.
