♦ Saturday, Oct. 23. (Before M. Keogh, Esq., R.M.) Drunk and Disorderly. — J. M'Connachie was charged with being drunk and disorderly. This was the fifth similar charge against the prisoner, and he was fined L 2 or four days' imprisonment. The same person was charged under the Vagrant Act with, being an habitual drunkard, but was dismissed with a caution. ■ , I ' CIVIL CASE. Greymouth Gold Mining Company v. ' David Girdwood. — The Magistrate gave judgment in this case, which was heard on Friday last. So far as we were able to catch what he said, from the low tone in which he spoke, it was somewhat to this effect, that he had carefully studied the Acts in this case, and it was quite clear that the legal manager of the Company was still Mr Masters, but at the same time Mr Lahman was acting in some such capacity, and had authority from the Company, and' as such made the demand on Mr Cardno, and received payment of one call from him in his office. The case was in a most unsatisfactory state ; several poh.t3 that should have been brought out had been neglected. The register, of shareholders ought to have been produced, showing that no transfer had been made. He had a right to suppose that Cardno was recognised as the holder of the shares by the acting manager of the Company. He had, therefore, no hesitation in entering a nonsuit in the case, so as to leave the question of the ownership of the scrip still open. Sooner than have an application for a re-hearing of the case he would order a nonsuit with costs. He might mention that, as a Warden, he naturally felt very great interest in the welfare of this Company, or any other mining Company brought into existence under the Mining Companies Limited Liability Act, and he thought it a pity that proper attention was not paid to the preliminary work as required by the Act.
