Thursday, Oct. 21. (Before Mr Warden Lowe.) . Matthew Constantino v. Stephen Camoletta. — An action to recover the balance of the purchase money for a share at Napoleon's. Adjourned for a week for the production of a certain agreement. This case appeared to excite a considerable amount of excitement among the miners ; the Court was crowded during its hearing. Thos. Maxwell v. German Charley.— For taking illegal possession pf 14 feet of ground at Moonlight, and causing an obstruction on plaintiff's claim by felling timber on it. Damages laid at L 5. Verdict for plaintiff for L 2, with L 3 14s and COStB. ' Cosgrave and Co. v. Nelson and Co.— An encroachment at Napoleon. Plaintiffs alleged in their plaint that defendants had taken 368 square feet of wash-dirt from them, containing 10.76 12s lOd worth of gold, or an average of sdwt. Ifgr. gold per truckful. When the case was called the plaintiff did not appear, but his agent said he had been in attendance all day. Case dismissed ; plaintiff to pay L 4 7s and costs. A fresh summons has been issued in this case. Joseph Gleave and Co. applied for a site for stacking tailings at Brandy Jack's. The application was opposed by Wm. Crowe. Granted on condition that Crowe be allowed to take a tail-race through the ground applied for, provided he securely covers it in. ' John Quinliven and Co. applied for a grant of water for a head-race at Moonlight. Opposed by Longnire and Co. Application granted, with a reservation of a right of Longmire and Co. to two small tributaries, which Quinliven and Cb. pror posed to include in their water grant! Longmire :and Co. were fined L 2 in connection with this case, for not complying with the regulations with respect to posting notices. . Charles O'Hara applied for a waterright in a small creek at the Mosquito Opposed by Wm. Burns and Co. and by Clemens and Co. Permission granted to use the water one day in the week, provided no person actually working in the creek required ic. There were several other applications and objections not of any general interest.
