WARDEN'S COURT, RUTHERGLEN.
Monday, August 30. (Before M. Keogh, Esq., KM.) Sullivan and Company v. Hogan and Company. — Sullivan and Company took up a claim on the Eight-mile about ten days' since, and as their resources were limited in a pecuniary sense, three of the party undertook to assist a butcher to erect a stock-yard during the mornings, leaving two of their mates to go on with the preliminary work, preparatory to sinking a shaft. Now, this ground, which adjoined Burkes claim, was looked on as very valuable, and Hogan and Company taking a fancy to it, pegged it off when the two men were absent. The evidenco went to show that very little work had been d/me on the claim since it had been pegged off by Sullivan and Company, in fact one of the witnesses for the defence swore that he had seen the plaintiffs about for the last eight or nine days, and that all the work done on the claim he could do liimself in a day, although a poor workman, and that the shaft was only down eighteen inches. The Warden said it was clearly a case of shepherding on the part of the plaintiffs, On the other hand, three of the defendants, had no standing in the Cou,rt, as they did not possess, miners' rights on the day the ground was taken possession of. He should fine them £1 each. Judgment for two men's ground for the plaintiffs, and three men's ground for defendants, who would have the choice of ground, plaintiffs to pay expenses, £2 Is,,
