Tuesday, August 18. (Before W. H. Revell, Esq., R.M.) CIVIL CASES. Rnben Waite v. -James Payne. — This was a case on adjournment from Nelson. Mr Perkins appeared for the defend en t, but as there was no appearance for the plaintiff, the case was dismissed. John Harris v. C. Hammond. — Claim of LI. Judgment by default. Gardner v. Johnston. — Claim of L 9 0s Od, as balance of wages for work and labor done, and the contract price for clearing a section of land. The defendant offered L 3 18s in settlement of aJI claims, which was refused. After the case had been gone into, judgment was given for L 3 13s 6cl, costs divided. M 'Gavin and Co. v. James Brimble. — This was a claim of L 25 15s for boating potatoes from the North Spit to town, at the rate of 7s per ton. The defendant paid into Court L 22 ss, and averred that the agreement was for the work to be done at 6s per ton. It transpired in evidence that the defendant agreed with two parties to bring over the cargo of potatoes in their boats at 7s per ton, and mentioned at the time that if he gave the job to one party he would only pay 6s per ton, but would pay the extra Is in order to get the cargo over rapidly. One of the parties did not come to work, and the plaintiffs completed the contract. The Magistrate said the plaintiffs had carried oiit their agreement, and it was no fault of theirs if the other party had not fulfilled his. Judgment would therefore be for the amount claimed and costs.
