Thtjksday, July 9. (Before W. H. Revell, Esq., R.M.) Threatening Language. — William Thompson was charged on the information of John Roach, both of Cobden, with having threatened to take his life, and he asked that the defendant should be bound over to keep the peace. The case having been satisfactorily proved, the defendant was bound over to keep the peace for six months, himself in LlO, and two sureties of L 5 each. CIVIL CASES. Joyce v. Wright.-- -The Magistrate gave judgment in this case, which was heard last Tuesday. The Magistrate said the potatoes in question were sold by auction on the wharf, svnd were knocked down to the plaintiif who bought the balance more or less. The point raised was that the potatoes were not weighed, and no right of property in them was vested in the purchaser until this was done. But a portion of the lot had been weighed, which was a constructive delivery of the whole to the plaintiff. Then the defendant, by his agents, removed the potatoes which were the property of plaintiff. There was no evidence to prove that the goods were put on board the vessel as ship's stores. The defendant had no right to interfere with the property, and take possession of it. Judgment would be for the plaintiff for the value of the potatoes, L 3 10s, but no damages would be allowed. Mr Guinness said tho plaintiff had not paid for the potatoes. The Magistrate said the plaintiff was liable for the amount. Judgments by default were given in the following cases : — Kerr, Keogh and Co v. R. Reeves, H 10s ; Grogan v. Harrison, L 7 36s ; Pollock v. Duncan, L 6 3s. Friday, July 10. There was only one case set down for hearing to day— an information by the Sergeant of Police in charge of the Rutherglen district, against a shanty-keeper at tho Limestone diggings, for obstructing him in the discharge of his duly, while searching for liquor. After hearing the evidence, tho Magistrate dismissed the case.
