An important commercial,, decision was given by Judge Williams in banco to-day. Prior to 1579, if a debtor was "adjudicated a bankrupt on a creditors' petition, the title of a trustee related back to any Act of Bankruptcy for which the debtor was was capable of being adjudicated a bankrupt. In the session of 1879, Mr W. D. Steward obtained an Amendment of Bankruptcy Act, by which the title of a trustee, when a debtor filed a declaration of insolvency, related back in the same manner, as if the debtor had been adjudicated a bankrupt on a creditors' petition. Mr Denniston, for the holder of a bill of sale in the case under notice, contended the Act had not this effect, but the judgment holds the contrary. It is understood that the Chief Justice and Judge Richmond hold the same view as Judge Williams.
