LYTTELTON BOROUGH COUNCIL.

The above Council met on Monday night, when there were present the Mayor, Councillors Chalmers, Weybnrne, Webb, Garforth, Eeed, Stinson, Smith. Leave of absence was granted to Cr. Macdonald. The receipts since the preceding meeting amounted to £234 13s 4d. The burgess roll for the current year was signed. A Mrs Godfrey applied to have the rates upon her cottage in Exeter street remitted. On consideration of her case the request was granted. The balance-sheet for the past year was laid on the table, duly audited, aud was ordered to be advertised. Accounts amounting to £152 5s 4d wore passed. The engineer at the pumping station, Mr Kent, sent in his usual report on the stats of the works. The following petition was road by Or. Chalmers :—“ To His Worship the Mayor and Councillors, —Feeling dissatisfied with the recent decision arrived at by the Council in connection with the settlement of the boundary of a section abutting on the bridle path and Ticahurst road, we hereby respectfully petition that a careful survey be made with a view of definitely establishing the proper position of the said bridle path, and that all encroachments, if any, should be at once removed.” The petition was signed by 161 signatures. Cr. Chalmers moved the memorial be received, seconded by Cr. Webb, and carried. Or. Stinson said MrMcLcllan had gone round the town, saying he would not get justice as long as himself and the Mayor were in the

Council. As far aa he was concerned, he had no objection to tbo survey being made. Ab far as his section was concerned, it was a : town section, and a tracing of it could be got at any time. Or. Garforth said Mr Lee was prepared to give up his encroachment if what he gave was returned to him. That was, of course, without any prejudice one way or the other to the petition. The Mayor said there were signatures in the petition of persons who had since stated they were under a misapprehension of its nature. Or. Smith spoke to similar eifect. Or. Chalmers thought the survey work from Mr Cuff's office wes generally reliable. Like doctors, it had been his experience, surveyors d’ffercl. The Mayor said that one time he was under the impression the property belonging to Or. Stinson was encroaching upon the road, hut after seeing the surveys made which had been made both by Cr. Stinson’s, Mr P. Cunningham’s, and his own surveyor, he was satisfied there was no error, Cr. Used aekad what the width of the Bridle path was ? The Mayor said he did not know. Or. Stinton said it was different widths. Or. Webb said the petition aimed mainly at the lower part of the road, and he thought the signers of the petition had a perfect right to ask for a survey to be made, or to say what the width of the road really was. Or, Chalmers said that having introduced the petition he should perhaps bo expected to move in the matter. Until, however, Captain McLellan took some positive step he did not think of doing so. The Mayor did not think anything was to be gained by the signers of the petition, as did also Cr. Reed, who said the road was wide enough for all purposes. Or. Webb said the signers of the petition held another petition. Cr. Garforth felt sure that the signers of the petition would not sign that Mr Lee’s fence, which had been put up with the sanction of the Council, should be pulled down. Cr. Weyburne said if the alteration ware made as asked Tioehurst road would be simply unapproachable, The clerk was ordered to acknowledge receipt of the memorial, and to state that it would receive the careful consideration of the Council. Or. Webb voted against the resolution. Some discussion took place upon the propriety of amending the building bylaw, but upon the motion of Cr. Chalmers, seconded by Cr Smith and supported by Crs. Webb and Weyburne, the matter was dropped, the understanding being that the by-law be enforced hereafter, and that the concession made in Mr Curtis’s case would not bo regarded as a pracedent by the Council. Some complaint was expressed about the early hour at night at which the nightcart is taken round, and the pestilential state of the drain near Mr Krriokaen’a in Exeter street. Ho knew of one case of diphtheria in that neighborhood lately, and another case had occurred since. Or. Reed again pointed attention to the sewers in Dampiet’s Bay. The Mayor undertook to go and see about those places. Cr. Chalmers asked permission to move, without notice, the following resolution : “ That the member for the town be requested to urge the Government to introduce a Bill in Parliament to define the law of toe foot* path s such Bill to be subject to adoption by ibcal bodies requiring it.” Permission was given, and the Councillor proceeded to show the necessity for an Act of Parliament to regulate the traflie on the streets. The resolution was seconded by Or, Weyburne and was carried ; Crs. Reed, Garforth and Smith against. The Council adjourned to the 9ch instant.
