IN' CHAMBERS. This Day. [Before his Honor Mr Justice Johnston.] His Honor sat in the Court Chambers at noon, RE JAMBS HARBIB, DECEASED, Mr Ootterill applied herein for an order granting probate to C. T. Oholmondeley and Q. S, Fleming as executors. His Honor granted the application. EE P. PATHEBON. Mr MoOonnel applied for an order granting costs out of the estate. The order was made. EB B. H. WILLIAMS. Mr Stringer applied for a similar order. Hia Honor made the order as prayed. EE WM. SMITH. On the application of Mr MoOonnel, his Honor granted an order of discharge herein. LAW PRACTITIONERS ACT AND BE MESSES THOMAS AND BBITGHB. Mr McConnel applied herein for an order for delivery of bill of costs. Mr Bruges appeared to consent, on condition of the time for delivery being extended from seven days to fourteen. His Honor made an order by consent as arranged. NECK V MAHEB. Mr McConnel applied herein for a commission to issue to Sydney to examine a material witness.

His Honor made the order as prayed, the commission to be returnable by the Ist April next; EE OHAELBS KITES, BEN., DECEASED.

Mr George Harper applied for an order granting probate to Charles Kiver, jun., and Henry William Packer, as the exeoutois named in the will.

Hia Honor made the order as prayed,

BE GHOBGB LIQERTWOOD, DECEASED. Mr G. Harper moved for letters of administration herein, with exemplification of probate annexed, to Frederick Banks and Fnibert Archer, as attorneys for the executrix. Hia Honor granted the application, limited to property in New Zealard.

KB EDWAED LOUIS CLOOSTOUN, DECEASED. Mr Harper applied for an order for letters of administration to Ellen Ologstoun, as executrix, and for approval of sureties. Order as prayed. EE JAMES WYVILL. Mr McOonnel obtained an order herein for payment of costs out of the estate. EE JOHK WILLIAM TUEKBE. Mr Bruges applied herein for a rule nisi, calling upon the creditors’ trustees to show cause why they had not paid a dividend on the claim of John Whitelaw, and why they have not called a meeting of creditors within six months of the bankruptcy, to explain why they have not declared such dividend. His Honor pointed out that the creditor for whom Mr Bruges appeared had waited a year since the bankruptly. Hence the application might have been made long ago and not in the vacation. If th" profession did this, they would have no vacation at all. The Chamber sitting in the vacation was intended only for urgent matters. However, tko rule would be granted, returnable at first sitting after long vacation.

EB JOHN OEIEEBOK, DECEASED. Mr Bruges applied herein for probate to Charles B. Grierson and Trevor J. Grierson, as executors named in the will. His Honor granted the application, leave being reserved to the executrix to come in and prove. BE GEACE BBOWN, DECEASED. Mr Bamford applied for probate herein to the executor named in the will. His Honor made the order as prayed. BE CLAIM OF KOBEBT -WILKIN. Mr George Harper applied herein for a rule nisi, calling on the Minister for Public Works to show cause why the sura of £4G9 12s 6i should not bo struck out of the award. The sum mentioned was the costs of the cause which the claimant had been adjudged to pay, but ho submitted that under the 50th clause of the Public Works Act these costs ought not to be incorporated in the decree or award until an opportunity had been afforded to ascertain the costs tax the same. His Honor did not think the intention of the Act was that the Court should, prior to the final award, ascertain what were the respective costs of claimant and defendant. However there was sufficient in it to make it arguable, and Mr Harper might taka his rule nisi. . ... Order rule nisi granted, cause to be shown at the sittings in Banco on March 14th, proceedings herein to be stayed meanwhile.
