COMPENSATION COURT.

Wednesday, Septembeb 14.

The Oourt re-opened at 10 a.m. before his Honor Mr Justice Johnston and Messrs O. N. 801 l and H. Mcllwraitb, assessors. The case of Robert Wilkin v Minister of Publio Works was resumed by Mr Harper, for the claimant, who replied to the arguments advanced by Mr Joynt, and also commented on the evidence at some length. Mr Joynt having replied, his Honor delivored the judgment of the Oourt as follows :—The Court are unanimously of opinion that some acceleration of the destruction of the claimant's land has taken plaoe in consequence of the works in question ; but as they are bound by section 38 of the Immigration and Publio Works Act Amendment Act of 1871, they are obliged to come to the conclusion that the enhancement of the value of the adjoining land, the property of tho claimant, by the construction of the railway is more than equivalent to the loss which he has sustained, and they, therefore, regret that they are bound to refuse the claim for compensation. Costs to be paid by the olaimant, except the costs of the argument of question of the law of limitation, which are to be paid by the respondent. The Oonrt then rose.
