MAGISTERIAL.
CHRIST OHUECH. Friday, July 29. [Before O. Whitefoord, Esq , E.M.] Attempted Eobbbby.—Edward Barry was brought up, the following charge being made against him, that “he did with menaces demand of one Annie B. Eeeve money on a certain highway, to wit, the Fendaltown road, on July 27th, contrary to section 45 of the Larceny Act, 1867.” Annie E. Reeve, a domestic servant, deposed that as she was returning to her employer’s house in Feudaltown road about 5 p.m. on the 27th she met prisoner on the bridge. He asked her several times if she had any money. She said she had none, and tried to get away. He followed her, and using very bad language threatened to throw her in the creek if she did not gvsl im money, She offered him her basket and umbrella, which he refussd. A carriage came up at that moment and she ran after it, prisoner following her for some distance, after which he went away. He had been to her employer’* some daya previously begging. George Hagan, gardener, employed by Mr Osborn, said he had seen pri goner begging so viral times. The girl had told him on the evening of the 27th that prisoner had stuck her np. Henry Cox deposed to having heard prisoner beg food several times in Fendaltown. Detective Neil stated that he had arrested prisoner in a tent in Duncan’s paddock, Norman’s road. There was a Maori kit in the tent containing broken victuals. Prisoner denied having in any way interfered with any female on the roadside. The Magistrate said he would deal with the case under the Vagrant Act, It was lucky that the offence did not quite come wif.h’n the meaning of the provisions of the Larceny Act, as in that case ho would have gone up to trial. It would, however, be dealt with in such a manner as would probably sufficiently punish the prisoner and act as a warning to others. Be would be sentenced to six months’ imprisonment with hard labour.
