At the Appeal Court, in the case Queen v Moritzan (Dunedin), the oonviotion was affirmed, and judgment ordered to be given at tbe nox' circuit sittings of the Supreme Court in Ltanedin. Io Meroer v Queen the demurrer was overruled, and leave given to plead within twenty-eight days on payment of the costs. In Murphy v Queon (Christchurch), judgment was reserved, there being a manifest error in the first and second counts of the indictments, and that a rooord be remitted to the Court below, in order that it may pronounce proper judgment thereupon. In Kilbeme Ratepayers v tho Hutt County Counoil, the Court hold that the plaintiffs had good cause for action, and the demurrer ought to bo overruled with costs.
