OHBIBXOHUEOH. Monday, December 6. [Before His Honor Judge Ward.] The Court was opened at eleven o’clock, and the list of cases was disposed of in the manner following:— JOHN CHEW V. JOHN PRATT. Mr Holmes for plaintiff, for the defendant Mr Joynt. This was a claim of £SO, damages for alleged false imprisonment. Mr Joynt applied for an adjournment, his witnesses not being present. Mr Holmes offered no objection. The case was accordingly adjourned till December 9th, defendant to pay costs of witnesses and counsel’s foe. CREDITORS’ TRUSTEE IN BANKRUPTCY OP J. HIKE V OSBORN. Mr Izard for plaintiff, Mr- Stringer for defendant. A claim of £l5O, damages for alleged wrongful conversion of property. After hearing evidence and legal argument, His Honor reserved his judgment, requiring time to consider certain law points raised. GEO. COOPER, JUN. V HALL. Claim £67 5s lid, value of goods sold and delivered. Adjourned to January sth. Defendant to pay costs of witnesses from Akaroa. J. T. POBD AND CO., 0. NEWTON, AND T. MABBDSN T. P. CONNOLLY. Mr Harper and Mr Isard for plaintiff and defendant respectively. Claim, £SO for rent. Adjourned to December Bth, by consent. SCHOFIELD AND BOSS V. JOHN BLIGH. Mr Spackman appeared for the plaintiffs ; Mr Stringer for the defendant. This was an action to recover 620 gallons of whale oil (or value £126, with, damages £2O), obtained from the whale which was stranded on the New Brighton beach. The defence was that the plaintiff and defendant were partners in the concern, and that the defendant bad a lien upon the oil for the expense incurred in procuring it. After the evidence of the plaintiff bad been heard, it was arranged, upon a suggestion from his Honor, that the parties should agree to refer the matter to an arbitrator, who should value the oil, and that such a proportion as would repay Mr Bligh for expenses should be retained by him ; the balance to be divided into three equal parts, the defendant to retain one third, and the other two thirds to be handed over to the plaintiffs. The Court then adjourned.
