MAGISTRATES' COURTS.

LYTTELTON. Tuesday, September 28. [Before J. Ollivier and T. H. Potts, Esqs., J.P'e.] Thb Mate op the Sabah and Maby.— Edward Keiu-oa was charged with the larceny of an aneroid barometer, a signal book and a pair of binocular glasses, belonging to the Sarah and Mary. William Dsmpsey, part owner of the loot vessel, gave evidence es to the purchase of tho articles by himself and the master, Captain Forman. He produced the receipts for the payment of them. The accused occupied the post of mate on board, and had no such articles of his own on board. Witness was able to identify tbo barometer by marks he had made upon it with a penknife. The marks had been partially obliterated. He identified the glasses in the same way, and the book by its general appearance. Accused had, in conversation with the witness, denied that he had any binoculars in his possession. The articles in question were found in his box at the hotel subsequently, upon a search warrant. The witness was cross-examined by the prisoner at length as to whether he was not aware that the articles had been given to prisoner as part payment of wages, but the witness was sure he knew nothing of it. W. H. Eyes, clerk of the Court, read the evidence of the master given at the inquiry, to the effect that the articles found on the prisoner were lost wilh the vessel. Thomas Wright, watchmaker, testified to having made out the portions of the name of the vessel upon the barometer, as did also W. H. Lance and the sergeantmajor of the police. In defence, prisoner staten that Eorman gave them to him as part payment of £3. This the Bench refused to believe, and sentenced him to two months' imprisonment.
