Constable Allen stated that the previous day he saw the accused riding the horse, outside the Court, in Colombo street. The horse appeared to be Buffering extremely. Serjeant Morice deposed that the horse was quite unfit. He was Buffering from diseased skin, had a raw wither, and he was in a very low condition. Their Worships, after looking at the animal, endorsed the evidence of the last witness, but considered, as there was no evidence of its having been used more than on the one occasion in question, a fine of 20s would meet the justice of the case. At the same time the accused was cautioned that if he used the horse again he would render himself liable to imprisonment.
