[By Teleguaph ] WKLL7N-3TON, May 30. The manager o! tho Now Zodand PrtM Association sued in tho District Coin v ’r ‘‘New Zealander ” Company lor Jf ul7 6s 8.1 lor agency services ami telegrams supplied. > Mr Stafford, who appeared for defendants, raised lour objections. First. That an agent such as tie manager, could n:it em a principal without authority. Second i bat by the Statute of Frauds the contract was not goon. The thir > and fourth obj jetions were practxca ly to this eff. ct:— I hat the members of the Association were partners, and could not proceed against each other in that way. JUr Sieve'right, in urging the claim ol the pi intiff, said, that the course adopted by thO ppposjag counsel was not creditable.
The Magistrate interposed, saying that had nothing to do with the question, which was purely one of law. Ho said ho saw that the case was bristling wuh difficulties from the first. As tbe Court was one of law, and not of equity, the must te decided the same as if in the Supremo Court He held that three of the objections raised by Mr Stafford were good, the second being bad, and ho non-suited the plaintiff. It is understood that the object of the defence was to protect the interest of the creditors of tbe company, which is iu liquidation, and that there was a further heavy claim of the Association against the company which would have been sued for bad the present case resulted iu favor of tho plaintiff.
