The Globe. TUESDAY, OCTOBER 2, 1877. TOOMER v. BANKS.
The Resident Magistrate gave judgment in this case this morning, declaring the election of Mr Banks to be void. He also ruled that the candidate next highest on the poll must, under clause 50 of the Regulation of Local Elections Act, 187 G, be declared elected. However, until he had the evidence of the Returning Officer, he was not prepared to state who stood next on the poll, so adjourned the case until 10 a.m. to-morrow, for the purpose of taking Mr Lee’s evidence. The result is, of course, that Mr Toomer having received the next highest number of votes to Mr Banks, will be declared elected.
