CITY COUNCIL.

Friday, April 30. A special meeting of the City Council was was held at four p.m. yesterday. Present — His Worship the Mayor, Crs Hart, Bishop, Gapes, Ick, and Raphael. The Mayor having explained the position of the cab case, Dr Foster stated that he did not consider it necessary for the Council to go further in the case of Goodger, as the point involved was a merely technical one, and not at all an important one. Tbe following resolution and amendment left over from Monday night were discussed at some length :—" That in case of an adverse opinion bein» given by the Judge in the cab cases, Dr Foster be instructed to take them to the Court of Appeal." " That the decision of Mr Justice Williams be accepted as final." After some discussion both resolution and amendment were withdrawn. Cr Raphael then moved—" That the cabmen be summoned at once under the byelaw." If so advised by Dr Foster, he would move that the cabmen who had licences should also be summoned if not carrying out the bye-law. Ultimately, on the suggestion of the Mayor, Cr Raphael amended his resolution as follows :—" That Dr Foster be authorised to communicate with the police, and instruct them to take action against the cabmen as to summoning those who shall offend against the Hackney Carriage bye-law." Cr Ick seconded the motion, which was agreed to. Cr Raphael moved—" The Council being advised by the city solicitor that the decisions of the Supreme Court in the cases of Reid and Goodger are in favor of the position assumed by the City Council during the late dispute are satisfied to abide by such decision." Cr Gapes seconded the motion, which was agreed to. In reply to his Worship, the city solicitor stated that he thought the decision of the Judge practically disposed of the action for damages.
