THE DEELEY ENQUIRY.

LOCAL CLUB’S APPEAL DISAIISSED.

AUCKLAND, Dec. 24. ■' The New .Zealand Racing Conference concurred in the decision of the Hawke’s Bay Metropolitan Committee, and dismissed the appeal of the Poverty Bay' Turf Club in .all particulars in regard to the disqualification of Deeley for the riding of Andrew Alack at tlie Poverty Bay Turf Club’s meeting on October 30.

The grounds set out .are : —lst. We are of opinion that it was open to the Hawke’s Bay Metropolitan Committee to hear the appeal to it inasmuch as Deeley was sentenced for “not riding his horse out,” which we decide to be a question of opinion, and not a “question of fact,” under rule 7 of part 31 of the rules of racing. 2nd. That in view of the difference in distances (and weights in the two races in which Andrew Mack and Tarina met, and in view of other performances of the two horses, their form in these races could not be regarded as inconsistent or suspicions; 3rd. That no confirmatory evidence has been produced tending to show any motive for Deeley’s alleged malpractice. We therefore concur in-the decision of the Hawke’s Bay_Metropolitan Committee, and dismiss the appeal of tlie Poverty Bay Turf Club in .all its particulars.
