A CARTING CONTRACT.
DISPUTE OVER PAYMENT.
Yesterday at the Alagistrate't Court Alessrs Gordon Bros. (Air. Bright) sued Black Bros. (Mr. Coleman) for £3 for work and labor done in carting sand. James Gordon said he had a contract for c u-tiiig goods to Dr. Cole's farm at AA'hangara, die price being £OS. and the goods to bo carted wen contained iu a schedule. Bcrid wai not included in the list, hut he cart, ed two loads of sand for which k( claimed £3. Defendant. Volte) Black, admitted liability, and gavi him an order for tho amount on Dr Cole t lmt the. order had not been me as Dr. Cole denied liability. Defend ant afterwards denied ordering witness to cart sand. D. L. Gordon give similar evid cnce. George William Cole, medical prac titioner. said defendants were erect ing a house for him at AVhangara Defendant, Walter Black, one da; said the carting of sand was not ii the contract, and wanted witness t< pay the account.
