AN IMPORTANT DECISION. United Press Association—Copyright LONDON, Alay 19. The Court of Appeal at Dublin, overruling Air. Justice Wylie’s decision, declared that in spite of planters or farmers who had planted on estates in place of evicted tenants offering to dispose of their interests to the Estate Commissioners, in order to facilitate the reinstatement- of evicted tenants, tho Commissioners are debarred from acquiring such land, against the. will of tho landlords. The case arose out of the proposed acquisition under the Evicted Tenants Act, 1907, of 4000 acres of the Clanricarde estate. The Court holds that the compulsory acquisition applies only to holdings of new tenants, who are not bona fide tenants, or are using or cultivating tlio land as ordinary farmers.
