THURSDAY, APRIL 30. (Before Air. W. A. Barton, S.AI.) DRUNKENNESS. William Stewart ami John Erickson were each fined 10s and 2s costs, in default 48 hours’ imprisonment. Charles Roy Stewart was convicted and fined £l, with 2s costs, in default 48 hours’ imprisonment; and a first offender was dealt with in the usual manner. PROCURING LIQUOR. On a charge of .procuring liquor during the currency of a prohibition order against him, Charles Roy Stewart was convicted and fined £lO, with 2s costs, in default two months’ imprisonment with hard labor in Napier gaol. BREACH OF THE CHATTELS ACT James Percy Gaffrey was charged with having, at Taihape, on .October 31st, 190 G, committed a breach of the above Act. On the application, of tho .police defendant was remanded until May Still. A LIABILITY CASE. Alfred Wade (Air. T. A. Coleman), proceeded against Herbert John Brownlee (Mr. Bright) for tho alleged dishonoring of an order for £53, and for which the defendant had said that lie would be responsible. Alfred Wade said that he received tho order from Afessrs. Chambers and Keam, and it was accepted by the defendant. Before accenting the order, defendant telephoned to Air. Stracham, after which he endorsed it. Three weeks afterwards, in Messrs. Chrisp and Coleman’s office, defendant said he would be liable for the amount, and promised to give .witness a certificate of .payment if he gave him an indemnity. On the order being .presented, it was dishonored. To Air. Bright: He demanded payment from defendant, and had made no demand on Mr. Straclian. Air. Bright asked for judgment on the ground that defendant was not liable as accentor of the order, as Air. Straclian was the drawer or addressee named in tlie order. Counsel quoted authorities ill support of his contention. Air. Coleman held that the authorities quoted did not refer to a “bill of exchange” as specified by the Act, and .pointed out that defendant had agreed to bo .responsible for .payment. His Worship reserved his decision, which will bo given this morning.
