His Honor Mr. Justico Button and a special jury to-day heard a case in which Richard Elliott, a baker, sued the City Council for £SOO for injuries received in a train accident on Brooklyn lino last May. The Council had paid £65 into Court in satisfaction of plaintiff’s claim. Tho Council contended that tho plaintiff was exaggerating liis injuries. . The jury awarded £250. A new trial is to bo moved for on tho ground that tho damages given by the jury aro cxcessivo.
