AUCKLAND, September IG. 11l the case at the Magistrate’s Court, where Karl Poller sued George Musgrove for £lO, a week’s wages, the defence being that the amount was deducted owing to plaintiff’s inability to sing his part, Mr. Maliony for defendant contended that ho had a right to fine plaintiff under clause 2 of the agreement, which stated that any person failing or neglecting to appear would lose three weeks’ salary. Mr. Sharpies contended that under the provisions of the Truck Act wages must ho paid in full ar.d a counterclaim for damages made. Mr. Mahony contended that the Truck Act did not apply to operatic singers. 1
