DUNEDIN, September 11., A ease said to bo the first ot its kind camo before the Arbitration Court this morning, when tho 1 nbtic Trustee, as legal representative oi James Ferguson, jun.. deceased ailing on behalf of Ins dependents, claimed t.‘:l7-l as compensation lioni the Bruce County Council in respect of an injury sustained by deceased in a road-making contract, which resulted in his dentil. Deceased was employed by his fatlior for this, amongst "other contracts. Accordingly the fatlior, who was a contractor, was bound to indemnify the Council against claims under the Workers Compensation for Accidents Act, and first thing this morning ho was bound over as respondent in tho action. The result is that, according to counsel for tho defence, if claimants aro granted compensation the Council may proceed against the fattier for recovery of the amount. Decision was reserved. Claimants refused an offer of £7OO with a guarantee tlint the father was to ho freed from all liability in the matter. The Court awarded £4OO compensation, loss ±.ll 6s funeral expenses.
